Commonwealth Report

ASIC has released Report 368 - Emerging market issuers (August 2013). ASIC noted a number of challenges that emerging market issuers are more likely to encounter than entities operating wholly in Australia, including:

red_triangle_bullet"good corporate governance and management systems";
red_triangle_bullet"complex ownership or contractual arrangements";
red_triangle_bullet"risks associated with relying on one or two key individuals located outside Australia"; and
red_triangle_bullet"the difficulty in accessing or verifying reliable information about an entity's operation and performance".

Mobile Phone Tracking by Retailers Could be Illegal

ABC News reports that former Privacy Commissioner Malcolm Crompton has warned that retailers implementing anonymous WiFi tracking technology to collect aggregate data about customer shopping habits through mobile phones, could be in breach of the Privacy Act 1988 No. 119 (Cth) if they are using technology from the US, which has a much narrower definition of personal information. 

According to ABC News, the technology currently in use in Australia does not allow consumers to opt in, with customers often unaware that they are being tracked.
